TERMS AND CONDITIONS

Bookings

All bookings are subject to availability and are only confirmed once the agreed deposit has been paid and written confirmation has been provided.

Until the deposit is received, the requested date remains available to other clients.

By paying the deposit, the client agrees to these Terms & Conditions.

Deposit

A deposit is required to secure your booking date.

The deposit is non-refundable if the client cancels, changes their mind, postpones without agreement, or no longer proceeds with the booking.

This is because once a booking is confirmed, the date is reserved exclusively for the client and may no longer be offered to other clients. The deposit also covers administration, planning, preparation, communication, scheduling, and loss of opportunity for that date.

Final Payment

The remaining balance must be paid by the agreed due date shown on the invoice or booking confirmation.

If final payment is not received by the due date, the booking may be treated as cancelled, and the deposit will not be refunded.

Cancellations by the Client

If the client cancels the booking, the deposit remains non-refundable.

If cancellation occurs close to the event date, additional cancellation fees may apply depending on the amount of preparation, travel, materials, or work already completed.

Any out-of-pocket expenses already incurred for the booking, including travel, accommodation, freight, materials, or special purchases, may also be payable by the client.

Postponements and Date Changes

Requests to postpone or change the event date are subject to availability.

Where possible, the deposit may be transferred to a new agreed date. However, this is at our discretion and depends on availability, notice given, and any costs already incurred.

If a suitable new date cannot be agreed, the booking will be treated as a cancellation by the client, and the deposit will remain non-refundable.

Travel and Expenses

Where travel, accommodation, freight, parking, materials, or other expenses are required, these costs will either be included in the quoted fee or charged separately as agreed.

Any non-refundable travel or accommodation costs incurred on behalf of the client must be reimbursed by the client if the booking is cancelled or postponed.

Changes to Event Details

The client must provide accurate event details, including date, time, venue, access requirements, contact person, schedule, and performance requirements.

Any significant changes to the event brief, location, timing, or scope of work may result in additional fees.

Outdoor Events

For outdoor events, the client must provide a suitable wet-weather plan and safe working environment.

If weather conditions, wind, rain, heat, poor lighting, unsafe surfaces, or other external factors affect the performance or artwork, we are not responsible for delays, changes, or reduced performance quality caused by those conditions.

Client Responsibilities

The client is responsible for ensuring suitable access, space, lighting, power, safety, parking, and event coordination are provided where required.

Any special requirements must be discussed and confirmed before the event.

Cancellation by Us

In the unlikely event that we are unable to attend due to illness, accident, emergency, or circumstances beyond our control, we will make reasonable efforts to offer an alternative date, replacement service, or refund of fees paid for services not provided.

We are not liable for additional losses, damages, or costs incurred by the client as a result of circumstances beyond our reasonable control.

Force Majeure

We are not responsible for failure to perform where the event is affected by circumstances outside our reasonable control, including but not limited to extreme weather, natural disasters, government restrictions, venue closure, transport disruption, illness, accident, emergency, or other unforeseen events.

In these circumstances, we will work with the client in good faith to reschedule where possible.

Artwork, Images and Promotional Use

Unless otherwise agreed in writing, we may use photos, video, testimonials, and behind-the-scenes content from the event for promotional purposes, including website, social media, marketing, and portfolio use.

If the client requires confidentiality or restrictions on promotional use, this must be agreed in writing before the event.

Intellectual Property

All original concepts, performance formats, artwork processes, designs, images, branding, and creative material remain the intellectual property of Brad Blaze unless otherwise agreed in writing.

The client may not reproduce, resell, copy, modify, or commercially exploit any creative material without written permission.
